This is a copy of  the email I’ve sent to Hutchison and Cornyn. Following up with phone calls.
(It’s on the email contact form, so no attachments.) Also emailing to Matt  Johnson in Cornyn’s office (whom I called yesterday).

Subject: Please oppose the nomination of David Nuffer for federal judgeship  in Utah

David O. Nuffer has helped facilitate the de facto decriminalization of
polygamy in Utah and Arizona. Had these states not refused to prosecute the criminal abuse of women and children in polygamous groups such as the FLDS,  Texas would not have had to spend millions of dollars prosecuting Warren Jeffs and his followers, and we would not be spending taxpayer dollars to  support their “celestial wives” (concubines, actually, but they qualify as single mothers) and their children.

In particular, the nomination of David Nuffer brings up these concerns:

1. In his responses to the Judiciary Committee questionnaire, David Nuffer omitted the fact that he served as Municipal Attorney for Colorado City, AZ  — the home not only of the FLDS but the Centennial Park group, the Apostolic  United Brethren and the Kingston group, all of whom are Mormon Fundamentalist  polygamists — for at least 10 years. I have a copy of his official 2001 resume, listing that he had held this position since 1991. All law  enforcement in Colorado City at that time was completely controlled by the  FLDS, and one of the area judges, open about his polygamous lifestyle, was  eventually unseated. Nuffer was very much aware of these problems but did  nothing — and then did not disclose this affiliation to the Senate Judiciary  Committee.

2. In his responses, Magistrate Nuffer listed In the Matter of the Adoption of W.A.T. as one of the top 10 cases he handled as attorney of record. In that case he successfully advocated that a polygamous family (FLDS) be allowed to adopt six children over the objection of their biological relatives. Of these children, none graduated from high school; one was abused and became a “lost boy”; two girls were placed in plural marriages with older men; and in 2005 the oldest adopted child (W.A.T., Wayne Alan Thornton Fischer) gave his 12-year-old stepdaughter, Brenda Lei Fischer, as a bride to Warren Jeffs. This young child was among those raped and impregnated by Jeffs in the YFZ Temple in Eldorado.

According to Janet Johanson, one of the aunts who tried to block the adoption  of her sister’s children, the FLDS paid David Nuffer’s firm $600,000 to handle the adoption and shortly thereafter he was made the Municipal Attorney for Colorado City.

Please, please take a stand in opposition to the nomination of David Nuffer.

And, I have a question: If a judge in Texas can be suspended, rightfully so, for beating his handicapped daughter over a period of years, how is it that a man whose actions led to the rape of a 12-year-old be nominated for a Federal District Judicial position?

This is truly an eleventh hour campaign, but emails and faxes run 24/7!

    As of yesterday 03/22/12, David Ogden Nuffer, was approved by President Obama as a federal judge, pushed in by Sen. Orrin Hatch, who stated the former Utah State Bar president has the experience, temperament and INTEGRITY TO BE A GREAT FEDERAL JUDGE. (caps are mine). What’s wrong with this picture??? Can anybody tell me how this man can be said to have INTEGRITY? bARFFF He allowed the rape of a 12 year old little girl to happen by Warren Jeffs in the temple at YFZ ranch in Texas. What’s wrong with UTardia. Don’t get me started cause I have yet begun . . .

    Just a side-note . . . I would like to think Sen. Mike Lee, R-Ut to be a patriot for casting one of the only two dessenting votes to seat Magistrate David Nuffer to a full judgeship. The other dessenting vote came from Sen. Jim DeMint, R-S.C., objecting! The senate voted 96-2. The article in the Salt Lake Tribune did state that Lee has voted against every single judicial and administrative nominee this year, a protest against the president’s recess appointment of Richard Cordray to head a new consumer watchdog agency that Lee argues broke the law. So – perhaps the ties the judgeship has to the FLDS didn’t have anything to do with the dessenting vote.
    I think it’s ironic that I ran across this article regarding ‘PLEASE OPPOSE THE NOMINATION OF DAVID NUFFER FOR FEDERAL JUDGESHIP IN UTAH’ on a Canadian website. Must have been ment to be . . .
